Obama Judge Rules Illegal Aliens Have the Right to Own Guns

An Obama-appointed federal judge in Chicago has ruled that illegal immigrants have a constitutional right to possess firearms. US District Court Sharon Coleman ruled on March 8 that an illegal with no record of violent behavior can't be prevented from owning a firearm.

At issue is 18 USC. § 922(g)(5), which prohibits anyone "who, being an alien, is illegally or unlawfully in the United States" from "possess[ing] in or affecting commerce, any firearm or ammunition; or to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce."

Judge Coleman took another look at the case. Upon review, Coleman concluded that Carbajal-Flores' illegally present status was not sufficient to deny him Second Amendment rights. The judge said the "plain text" of the Constitution "presumptively protects firearms possession by undocumented persons."

The court determined that because there is insufficient evidence to suggest Carbajal-Flores is a danger to society, there is no historical analogue that would permit the federal government to deny him his gun rights.

"The Court finds that Carbajal-Flores’ criminal record, containing no improper use of a weapon, as well as the non-violent circumstances of his arrest do not support a finding that he poses a risk to public safety such that he cannot be trusted to use a weapon responsibly and should be deprived of his Second Amendment right to bear arms in self-defense," Judge Coleman wrote. "Thus, this Court finds that, as applied to Carbajal-Flores, Section 922(g)(5) is unconstitutional."

Less Than 30 Percent of New Yorkers Enjoy Life in the Big Apple

The deterioration of America's major cities has been going on for a while now, and it's not only the infamous West Coast cities of San Francisco, known as the city of poop maps, or Los Angeles, the home of Bidenville homeless encampments and industrial-scale shoplifting rings.

New York City is experiencing similar problems, and now a survey of New Yorkers reveals how many New Yorkers are looking to get the H out.

Just half of all New Yorkers plan to stay in the city over the next five years, and anger over quality of life has skyrocketed since the pandemic — with just 30% saying they’re happy here, according to a damning poll from the The Citizens Budget Commission.

The non-profit think tank’s first such post-pandemic survey, released Tuesday, also found that only 37% of New Yorkers thought public safety in their neighborhood was excellent or good, down from 50% six years ago.
